The present petition has been filed setting aside the judgment dated 22.05.2018 passed by learned Principal District Judge, Family Court, Karnal, whereby, the petitioners were granted meager amount of maintenance of Rs. 10,000/- per month, which is inadequate and the same needs to be enhanced.

Learned counsel for the respondent submits that vide order dated 08.07.2022, the claim qua petitioner No. 1 has been rendered infructuous as she has already re-married. As regards the claim of petitioner No. 2 is concerned, learned counsel for the respondent submits that petitioner No. 2 has already filed a petition under Section 128 of Cr.P.C. before the Court below and hence, the present petition would not survive. Learned counsel for the petitioner could not deny the fact that the entire arrears have been duly paid during the execution and the petition under Section 128 of Cr.P.C. is pending before the trial Court. 4.

In light of the above, the prayer made in the present petition would not survive and hence, the present petition stands disposed of as having been rendered infructuous, however, the dismissal of this petition shall not be an impediment on the rights of petitioner No. 2 to contest the petition under Section 128 of Cr.P.C.
