***** ARCHANA PURI, J. (Oral) The present appeal has been filed by the appellants, for seeking enhancement of compensation, awarded by learned Tribunal, on account of death of Kalavati, in a motor vehicular accident.

In view of the contents of Paragraph No.38 of the impugned Award, it is evident that the compensation was worked upon, while taking the notional earnings of the deceased, as Rs.9,000/- per month, annual whereof was Rs.1,08,000/-. Besides the aforesaid, multiplier of '14' was applied and compensation, was worked upon as Rs.15,12,000/-. Under the conventional heads, on the count of 'loss of estate', an amount of Rs.15,000/-, on the count of 'loss of consortium' and 'funeral expenses', an amount of Rs.40,000/- and Rs.15,000/- respectively, was granted. FAO-1432-2021 (O&M) Being aggrieved qua the extent of compensation awarded, the appellants, who are the husband and children of the deceased, had filed the present appeal, for seeking enhancement.

However, now taking into consideration about the addition to be made on the count of 'future prospects', as well as deduction to be made on the count of 'personal expenses' of the deceased and all other circumstances, spelt out, from the material brought on record, counsel for respondent No.2-Insurance Company, gives an offer to pay an amount of Rs.1,25,000/-, over and above the amount awarded, as full and final settlement.

The said offer is acceptable to the counsel for the appellants. Keeping in view the amicable settlement, so reached, the appeal, as such, is hereby accepted and an amount of Rs.1,25,000/-, is ordered to be paid by the Insurance company to the appellants, within a period of six weeks from today onwards.

In the eventuality of any default on the part of Insurance company, the Insurance Company, shall be liable to pay penal interest @ 8% per month, till realization of the enhanced amount.
