Vs Union of India and others Respondents
CORAM:
HON'BLE MR. JUSTICE RAJESH BINDAL HON'BLE MR. JUSTICE AMIT RAWAL
Present:
Mr. Deepak Gupta, Advocate for the petitioner.
Mr. Sharan Sethi, Senior Standing Counsel for respondent No.2.
-.- RAJESH BINDAL J.
Order passed by the Settlement Commission dated 07.04.2017 has been impugned by filing the present petition only on the ground that in the case of the petitioner, penalty of ` 5 lacs has been imposed whereas in the case of Ankush Khullar, who was issued five notices, penalty imposed was the same.
As the jurisdiction of the Settlement Commission is to resolve the issues between the parties after they make admission of violation of law committed by evasion of duty, whatever immunity the Settlement Commission thought appropriate was granted to the parties. The case in hand is not such where jurisdiction of judicial review of this Court can be invoked.
