(Oral) Learned counsel for the petitioner at the very outset informed the Court that an ex-parte decree under Section 13 of the Hindu Marriage Act for dissolution of marriage filed by the petitioner was allowed.
The respondent-wife has approached this Court by filing FAO No. 6226 of 2019 challenging the judgment and decree dated 11.09.2019 passed by learned Principle District Judge, Family Court, Hisar and during the pendency of the appeal both the parties have settled their dispute amicably and the wife has taken the permanent alimony of Rs. 35 lacs.

2023:PHHC:102486 CRR(F)-419-2018 -2Order dated 26.04.2023 passed in FAO No. 6226 of 2019 has been produced in the Court and the same is taken on record. Registry is directed to tag it at an appropriate place. Order dated 26.04.2023 indicates that the wife has received the permanent alimony of Rs. 35 lacs and has also withdrawn the appeal against order dated 11.09.2019 vide which the decree of divorce was granted.
In view of the above factual position, learned counsel for the petitioner seeks permission to withdraw the present petition. Dismissed as withdrawn.
