(ORAL) Learned State counsel has opposed the filing of the present petition on the grounds that vide this petition, the petitioner seeks to arraign respondent No. 4-Ishwar Singh Nain as an accused, whereas there is specific legal remedy available to him under Section 319 Cr.P.C.

Given above, the present petition is disposed of having been not maintainable.

Liberty reserved to the petitioner to file an application under Section 319 Cr.P.C which shall be decided on its own merits in accordance with law. All interim orders are recalled.
