The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.246 dated 30.8.2020 at Police Station Kaithal Sadar, District Kaithal under Sections 379, 406 and 420 of Indian Penal Code.

At the time of issuance of notice of motion on 15.10.2020 the following order was passed:

" Learned counsel for the petitioner inter alia submits that the agreement was entered between the complainant and the petitioner but the petitioner is not running the business. The poultry farm is being run by his son and a relative. Further, as per the agreement, the complainant was required to send feed and medicines alongwith the chicks but since the same was not done, chicks received on 25.04.2020 were not MOHAN SINGH 2021.01.19 17:48 I attest to the accuracy and integrity of this document

( 2 ) CRM-M-30411-2020 (O&M) accepted. This is evident from the statement of son of the petitioner recorded in the enquiry concluded on 26.06.2020. The said enquiry found that no case for registration of an FIR was made out. However, subsequently, the petitioner got the present FIR registered at another Police Station and in this regard a complaint dated 09.09.2020 has already been made to CM window. Thus, the dispute is purely money dispute arising out of a business transaction. The complainant is also in possession of blank cheques given by the accused persons as security. Notice of motion for 19.01.2021.

Mr. Munish Sharma, AAG Haryana, accepts notice on behalf of the respondent-State and waives service.

In the meantime, the petitioner is directed to join investigation with the Investigating Officer on 27.10.2020 at 10.00 a.m. and cooperate therewith. In the event of his arrest, he shall be released on interim bail to the satisfaction of the Investigating Officer/SHO concerned subject to his compliance of the conditions enshrined under Section 438(2) Cr.P.C."

The learned State counsel, upon instructions from ASI Randeep Singh, has informed that pursuant to interim directions issued by this Court, the petitioner has since joined investigation and that his custodial interrogation is not required.

In view of the aforesaid submission, the petition is accepted and the interim directions issued by this Court vide order dated 15.10.2020 are hereby made absolute subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
