(Oral) Prayer in this petition is for transfer of MACP No.1763/2019 under Section 166 of Motor Vehicles Act, 1988, pending before the MACT, Bathinda to the competent Court of jurisdiction at Barnala. Learned counsel for the petitioner has argued that the petitioner has sustained 65% permanent disability and is unable to travel to Bathinda, as there is a distance of about 65 kms from Bathinda to Barnala. Learned counsel for respondent No.4-Insurance Company submits that he has no objection, if the aforesaid MACP case is transferred from Bathinda to Barnala.

TA-782-2023 -22023:PHHC:123532 After hearing the counsel for the parties and considering the submissions made by them, present petition is allowed, subject to the following conditions:-
1. The petition i.e. MACP No.1763/2019 under Section 166 of Motor Vehicles Act, 1988, pending before the MACT, Bathinda will be transferred to the competent Court of jurisdiction at Barnala.
2. The District Judge, Barnala will assign the said petition to the competent Court of jurisdiction.
3. The MACT, Bathinda is directed to transfer all the record pertaining to the aforesaid case to District Judge, Barnala.
4. The parties are directed to appear before the District Judge, Barnala within a period of 01 month from today. Present petition is disposed of accordingly.
