Main case On 27.07.2022, learned State counsel appeared on the basis of supply of advance paper book and sought time to have instructions for 08.09.2022. On 08.09.2022, learned State counsel sought further adjournment in the light of order dated 27.07.2022.

Today, learned State counsel on instructions from Mr. Rupinder Pal Singh, RTA, Bathinda submits that route from Bathinda to Sangrur via Maur, Mansa and Sunam is a monopoly JYOTI SHARMA 2022.09.19 13:17 I attest to the accuracy and authenticity of this order/judgment

CWP No. 16058 of 2022 (O&M) -2route and falls under STU category for which no regular timing can be issued to the petitioner.

Learned State counsel further submits that due to illegal act of an official who was at the helm of affairs at the relevant time, the aforesaid route permit was granted to the petitioner without verifying the aforesaid factual position. The departmental proceedings have been initiated against the incumbent and now further action in respect of aforesaid route is pending consideration before the competent authority i.e. RTA, Bathinda.

In view of facts and circumstances of the case, the competent authority is directed to decide the claim of the petitioner within two weeks. The final decision shall be taken by Regional Transport Authority after hearing the petitioner in person. Petitioner shall be at liberty to take all the pleas which are available to the petitioner in respect of route permit dated 21.01.2022.

Let the needful be done within two weeks from the date of receipt of certified copy of this order. Disposed of.
