(The aforesaid presence is being recorded through video conferencing since the proceedings are being conducted in virtual court) Petitioner prays for regular bail pending trial in a criminal case arising out of FIR No.402 dated 27.07.2019, registered under Sections 21(b) of the NDPS Act, 1985 (section 27(a) of NDPS Act, added later on), Police Station City Fatehabad, District Fatehabad. The present petitioner namely, Rano, was granted regular bail vide order dated 14.08.2019 (Annexure P-2). An application for exemption was moved by the petitioner for 07.03.2020 but the same was dismissed and the bail was cancelled. After having heard learned counsel for the parties and going through the material placed on the record, this Court is of the considered view that the present petitioner deserves to be extended the concession of bail considering the fact that she was on regular bail in this case. She was taken into custody only on account of non-appearance on 07.03.2020. As far as the other cases are concerned, it has been mentioned in the petition itself that she has been acquitted in three cases and in all other cases, she is on bail as the recovery was of noncommercial quantity. Taking into consideration the totality of the circumstances and without commenting on the merits of the case, it is considered as appropriate to release the petitioner on regular bail on her furnishing bail bonds/surety bonds to the satisfaction of the concerned trial court/Duty Magistrate/Chief Judicial Magistrate.
