Mr. Aditya Pratap, Advocate for Mr. Inderdeep Singh, Advocate for the complainant. NIDHI GUPTA, J. (ORAL) The petitioner is seeking anticipatory bail in case FIR No.166 dated 04.06.2023 registered under Sections 354 and 506 IPC at Police Station Sadar, Amritsar.
On 15.06.2023, this Court had passed the following order :- "Contends inter alia that petitioner as well as complainant are serving in Punjab Police.
Notice of motion.
Ms. Monika Jalota, Sr. DAG, Punjab, accepts notice on behalf of the respondent-State, whereas, Ms. Tarranum Madan, Advocate, causes representation on behalf of the complainant; and both seek time to have instructions and/or file written response in the matter. Posted on 07.08.2023.
In the meanwhile, petitioner shall join investigation before the Investigating Officer. In the event of his arrest, the Arresting Officer would admit him to interim bail, till the next date of hearing, on furnishing adequate bail and surety bonds to his satisfaction. The petitioner shall also abide by all the conditions as envisaged under Section RISHU KATARIA 2023.08.08 18:09 I attest to the accuracy and authenticity of this order/judgment
CRM-M-30559-2023 -2- 2023:PHHC:101900 438(2) of the Code of Criminal Procedure, 1973." Learned counsel for the petitioner submits that in compliance of the order dated 15.06.2023 passed by this Court, the petitioner has joined the investigation.
Learned State counsel, on instructions from ASI Gurcharan Singh, states that in terms of the order passed by this Court, reproduced above, the petitioner has joined the investigation. However, mobile phone is yet to be recovered from him.
In view of the above, the order dated 15.06.2023 granting interim bail to the petitioner is made absolute. However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join the investigation and cooperate with the investigating agency in case, he is required for the same in future as and when called upon to do so. In case at any given point of time hereinafter, it is felt by the investigating agency that the petitioner is required for the investigation but is not cooperating, they will be at liberty to approach this Court for passing appropriate orders.
The petition stands disposed of.
