The petitioner has been promoted as a Junior Engineer on adhoc basis while serving as a Lineman with PSPCL. By filing the present writ petition he is seeking a mandamus not to proceed with the enquiry on the basis of an anonymous complaint (P-1) since it violates instructions dated 13.12.2006 issued by the PSPCL. Upon notice, a reply has been filed.

In the reply it is submitted that the instructions only provide that the anonymous complaint need not be attended to. However, if there is some substance in the such complaint, it should be looked into. That apart, it is submitted that complaint (P-1) has been made by one Rajesh Sharma,Advocate of Jalandhar making allegations of corruption against the petitioner vide P-1.

CWP 10678/2017 Merely because the department is proceeding to have a fact finding enquiry does not violate any right of the petitioner. In fact, it is incumbent upon the Government officials not to let allegations of corruption or other serious misdemeanor go without enquiry and take subsequent necessary action. It cannot be disputed that in case any substance is found and further action is proposed, the same shall be taken in accordance with law.

Dismissed.
