Present Civil Writ Petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for quashing the advertisement dated 01.05.2020 (P-3) vide which respondent No.3 has advertised certain posts including the post of petitioner through contractor under outsource policy part-1. Further prayer is to direct the respondents to continue the petitioner in service under Outsource Policy Part-II till the regular appointment is made. Learned State counsel on instructions from Group Commander NCC Group Head Quarter, Ambala Cantt., District Ambala, has apprised the Court that petitioner is continuing as on today and will not be replaced by another employee until and unless some regular appointment is made to that effect.

Although, learned State counsel,3 while making reference to application dated-Nil (Annexure R-3) submits that petitioner is working under Outsourcing Policy (part-1) since 20.05.2020, but there is no date mentioned in this Annexure, therefore, he be treated to have been working under Part-II of the Policy with effect from 04.04.2012.
