*** AVNEESH JHINGAN, J (ORAL) The matter is taken up for hearing through video conference due to COVID-19 situation.

The present petition is filed for the grant of regular bail in FIR No. 73, dated 26th May, 2018, under Section 147, 148, 149, 302 of the Indian Penal Code, 1860 and Sections 323, 324, 326, 452 and 427 IPC added later on and Section 25 of the Arms Act, 1959, registered at Police Station Bass, District Hisar.

As per the allegations in the FIR there was a scuffle between the complainant family and the accused. Both the parties are from succession tree of a common grand-father. However, in the alleged incident one Sunil lost his life and injuries were inflicted to the others. One of the ground taken by the petitioner is that 10 members of the same family are behind the bars. There is a delay in the trial as the occurrence took place on 25th May, 2018 but till date only two witnesses have been examined.

CRM-M-30577-2020 -2However, after arguing for sometime, learned counsel for the petitioner seeks permission for withdrawal the present petition with liberty to revive the prayer at later stage. He further prayer to issue directions for the expeditious disposal of the trial.

Learned State counsel submits that earnest method would be made by the prosecution to produce the witnesses as early as practically possible. Dismissed as withdrawn with liberty as prayed for. However, considering that two related families are involved in the litigation and 10 members are behind the bars, trial Court is directed to expedite with the trial as early as practically possible, considering the COVID-19 situation and also ensure that un-necessary adjournments should not be granted.
