61. Through the instant petition, as instituted under Section 438 of the Cr.P.C., the petitioner seeks the concession of anticipatory bail, in case FIR No.48 dated 13.05.2024, under Sections 420, 465, 467, 468, 471 of the IPC, registered at P.S. Khamanon, District Fatehgarh Sahib.

2. Succinctly stated, the allegation(s) against the petitioner is that, at the time of taking the job, he presented a birth certificate which carried his date of birth as 12.09.1964, whereas, his actual date of birth was 12.09.1962. Therefore, by using a forged birth certificate, the petitioner continued in the job for two years more.



3. The learned counsel for the petitioner submits that, since the entire case is based upon documentary evidence, therefore, custodial interrogation of the petitioner is not required. Moreover, the petitioner is ready and willing to join the investigation and to cooperate with the investigating agency.

4. The learned counsel for the petitioner further submits that, although the petitioner is involved in four more cases, however, in one of those cases, he has already earned acquittal, whereas, in the remaining three cases, he is on bail.

5. Notice of motion for 29.07.2024.

6. Mr. Pardeep Bajaj, D.A.G., Punjab, accepts notice on behalf of respondent-State of Punjab.

7. In the meantime, the petitioner is directed to join the investigation and to appear before the investigating agency, as and when called upon to do so. In the event of his arrest, he shall be admitted to interim bail on his furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall abide by the terms and conditions as envisaged under Section 438(2) Cr.P.C.7
