(Oral) The present first petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the petitioner in case bearing FIR No.92 dated 29.04.2023 registered under Sections 302, 201, 34 of the Indian Penal Code, 1860 at Police Station Jamalpur, District Ludhiana on the ground of long custody i.e. nearly 03 years.

After this Court expressed a prima facie disinclination towards allowing the petition, learned counsel appearing on behalf of the petitioner submits that he does not wish to press the present petition at this stage and requested that considering the long period of incarceration undergone by the petitioner, the Trial Court may be directed to expedite the conclusion of the prosecution evidence.

Learned State Counsel has no objection to the prayer made by counsel for the petitioner and informs this Court that 08 out of 25 witnesses cited by the prosecution have already been examined/given up and that the matter is fixed before the Trial Court on 01.06.2026 for recording of the SUMIT SINGH GUSAIN 2026.05.21 09:47 I attest to the accuracy and integrity of this document
217 CRM-M-27125-2026(O&M) prosecution evidence. Learned State Counsel further submits that the prosecution shall take expeditious steps to conclude the prosecution evidence and, in any case, shall conclude the same within a period of six months from the next date fixed before the Trial Court. 4.
In view of the above, the present petition is disposed of as not pressed at this stage.

However, the respondent-State shall remain bound by the undertaking given before this Court to conclude the prosecution evidence within a period of six months from the next date fixed before the Trial Court. 6.
