(The aforesaid presence is being recorded through video conferencing since the proceedings are being conducted in virtual court) By way of moving present petition, the concession of regular bail has been sought by the petitioner submitting that initially he was granted regular bail by the Court but during the course of continuation of trial, he absented and was declared proclaimed offender on 28.01.2016. He was arrested in this case on 28.08.2019 and since then he is in custody.
Mr. Sukhbir Singh, AAG, Punjab accepts notice on behalf of the respondent-State and has not disputed the factual aspect. Further considering the fact that he was granted regular bail initially but is in custody on account of he being declared proclaimed offender, petitioner deserves the concession of bail. Taking into consideration the totality of the circumstances and without commenting on the merits of the case, it is considered as appropriate to release the petitioner on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of the concerned trial court/Duty Magistrate/Chief Judicial Magistrate.
