(Oral) In the present writ petition, the petitioners are seeking issuance of a writ in the nature of certiorari to quash the action of the respondentColleges not to pay the minimum pay scale prescribed by the UGC vide notification (P-2) to the petitioners and further prayer is to quash the action of the respondent-College to adopt the practice of discontinuing the Extension Lecturers/Assistant Professors during vacation period. On notice two separate replies have been filed by respondent Nos. 4 and on behalf of respondent No. 1 and 2. As per reply filed on behalf of respondent Nos. 1 and 2, it has been stated that petitioner Nos. 1 to 7 and 12 were allowed to continue as Extension Lecturers. However, at present 1 and 4 are working as Extension Lectures and petitioners NO. 2, 3, 6 and 7 have given resignation and petition No. 12 has been replaced on joining of regular appointee. CWP No. 14393-2016 -2has been stated that petitioner No. 5 has now completed his NET/JRF exam and is eligible for the post of Assistant Professor. He will continue as Extension Lecturer till joining of regular Assistant/Associate Professors in his respective subject. Further it has been stated that the petitioners are now being paid an amount of Rs.23500/- per month as per UGC norms and they are not being relieved during vacation period. Without expressing any opinion on the merits of the case, instant petition is disposed of with a direction to respondents to allow the petitioner to work till regular appointments are made. However, it is further made clear that if some new regular candidate joins, the petitioners can be relieved.
