**** ANUPINDER SINGH GREWAL, J (ORAL) The petitioners are seeking a direction to the respondents to pay them 12 per cent interest on the arrears, which had been paid to the petitioners. Learned counsel for the petitioners submits that the petitioners had been paid arrears of salary with effect from 2001 only in the year 2015 and, therefore, they would be entitled to the interest thereon.
Heard.
The petitioners had preferred CWP-58 of 2003, which was allowed on 29.08.2013 and it was directed that they will be treated as regular employees and would get all the consequential benefits. The matter is stated to have attained finality as the LPA preferred by the respondents was dismissed in the year 2015. It was open to the petitioners to have sought the interest on the payment of arrears in the writ petition they had preferred earlier. This petition has been preferred after 09 years of the decision in the earlier writ petition. Therefore, I do not find any merit in this petition for the grant of interest as payment had been made in pursuance to the order of the Court wherein there was no direction to pay the interest. The petition stands dismissed.
