**** RITU BAHRI , J. (Oral) Challenge in this petition is to order dated 24.04.2019 passed by learned Civil Judge (Jr. Divn.) Gurgaon.

On a specific query put by this Court, learned counsel for the petitioner has submitted that the petitioner had already filed an application before the Court under Order 1 Rule 10 for deletion of his name from the array of parties.

Learned counsel for the petitioner states that one of Director of both the companies i.e petitioner and ITX Services India Pvt Ltd are same. The appointment letter to respondent No. 1 has been issued by ITX Services India Pvt Ltd.

Since the Director of petitioner and ITX Services India Pvt Ltd are same, learned counsel for the petitioner wishes to withdraw the present petition with a liberty to file an application for impleading ITX Services India Pvt Ltd by filing an application under Order 1 Rule 10 CPC.
