By this petition, filed under the provisions of Section 439 of the Cr.P.C., the petitioner seeks the concession of 'regular bail', upon FIR no.56, dated 28.04.2019, having been registered at Police Station Buria, District Yamuna Nagar, alleging therein the commission of offences punishable under Sections 304-B and 34 of the IPC, with Section 498 thereof added subsequently.
Learned counsel for the petitioner submits that the petitioner has been in custody since 01.05.2019, i.e. for more than 1 year and 8 months, and that as a matter of fact the defence of the petitioner is that his wife committed suicide not due to any harassment but due to the fact that she was unable to bear a child after three years of marriage. Upon query to learned State counsel, he submits on instructions from ASI Charanjit Singh that the custody period is not denied, though otherwise he opposes grant of bail to the petitioner considering that a young woman died within 7 years of her marriage.
