On our asking, Ms.Kirti Singh, learned Deputy Advocate General, Haryana, accepts notice on behalf of the respondents.
Let five copies of the writ petition be supplied to the State counsel during the course of day failing which this order shall be automatically recalled and the writ petition shall be deemed to have been dismissed for non-prosecution. In view of the nature of order which we propose to pass, it is not necessary to seek any counter-reply from the respondents at this stage.
The petitioner is a resident of village Gagsina, Tehsil Gharaunda, District Karnal. His grievance is that the petitioner and his family were initially included in the voter list of Ward No.1 of his village but at the time of finalization of MOHINDER KUMAR 2015.08.21 14:06 I attest to the accuracy and authenticity of this document Chandigarh
CWP No.15408 of 2015 [2] the revised voter list, they have been abruptly shifted to Ward Nos.2, 3 & 17. His further grievance is that while preparing the revised voter list, even the dead persons have also been included. The aforesaid objections have been raised by the petitioner vide his application-cum-representation dated 02.07.2015 (P-2).
It goes without saying that Rule-10 of the Haryana Panchayati Raj Election Rules, 1994 obligates the Competent Authority to decide the objections and if so demanded, supply a copy of the order passed on such objections. We, thus, dispose of this writ petition with a direction to the Deputy Commissioner, Karnal to call for the records and ascertain the averments made by the petitioner in his application-cumrepresentations and decide the same by passing a reasoned order well in advance before the Gram Panchayat elections are held.
Ordered accordingly.
