Present petition has been filed under Article 226 of the Constitution, inter alia, for issuance of a writ in the nature of certiorari to quash Public Notice dated 16.02.2017 (Annexure P-5), whereby the respondents have deducted the marks of petitioners on the pretext of negative marking as advertisement in question for the post(s) of Sub Divisional Engineers (Mechanical) does not provide for any rules for negative marking and deduction of marks in the written examination. Upon notice, separate replies on behalf of respondent Nos. 1 & 2 stand filed.

It transpires that writ petition qua petitioner No. 2 (Sahil Bansal) had already been dismissed as withdrawn vide order dated 09.02.2021 passed by this Court.

Now, an application bearing CM No. 4185-CWP of 2022 (duly supported by the affidavit dated 09.12.2021 of Amandeep Singh / petitioner No. 1) has been filed by the applicant-petitioner, seeking withdrawal of the present petition.

CWP No. 10913 of 2017 (O&M) -2It is averred in the application that applicant-petitioner No. 1 has already been selected as Lecturer (Mechanical) with Deptt. of Technical Education, therefore, he does not want to pursue any further with the present case.

Learned State Counsel accepts notice on behalf the respondents / State and has no objection, if the present application is allowed and main case is ordered to be dismissed as withdrawn qua petitioner No. 1.
