The petitioner has approached this Court by way of instant writ petition under Article 226 of the Constitution of India for issuance of a writ in the nature of certiorari for quashing the order dated 28.04.2014 (Annexure P-6) vide which the Industrial Plot bearing No.170, Sector 2, Food Park, Saha measuring 450 sq. mtrs. has been ordered to be resumed. Further, a writ of mandamus has been sought directing the respondents to restore the possession of allotted plot as the petitioner had already deposited the entire cost of the plot and has also submitted the building plan which was approved by the authorities.

A bare perusal of the prayer clause as well as the petition shows that Annexure P-7 has wrongly been typed in place on Annexure P-6. Moreover, aggrieved against the impugned order dated 28.04.2014 (Annexure P-6), the petitioner has filed an appeal (Annexure P-7) before the Appellate authority and the same is still pending.

In such circumstances, we do not find any ground to interfere with the impugned order dated 28.04.2014 (Annexure P-6). Consequently, finding no merit in the petition, the same is hereby dismissed.
