**** JAISHREE THAKUR, J. (ORAL) The petitioner herein had participated in the selection process that was initiated for recruitment for the posts of Intelligence Assistants (Constable). Being successful, appointment letter dated 31.12.2016 was issued to him, which is annexed as Annexure P-4 with the instant writ petition. The only grievance of the petitioner is that despite being successful in the selection process and having appointment letter in his hand, he has not been allowed to join the services.

Notice of motion.

On the asking of the Court Mr. L.S. Virk, learned Addl. A.G., Punjab, who is present in the Court, accepts notice on behalf of respondents-State. Let adequate number of copies of the writ petition be supplied to him during the course of the day. Mr. H.S. Saini, learned counsel appearing on behalf of the petitioner contends that similarly situated candidates who were successful in the selection process but had not been given appointment had approached Satyawan 2017.05.19 16:47 I attest to the accuracy and authenticity of this document High Court Chandigarh

CWP No. 10927 of 2017 -2this Court by way of filing CWPs No. 4698, 5197 and 5211 of 2017 with a similar prayer. In those writ petitions, the matter had been disposed of by giving a direction that in case the petitioners are willing to give undertaking to the department concerned that their appointment/joining would be subject to the final disposal of Civil Writ Petition No. 12 of 2017, the petitioners may be permitted to join. He prays for a similar relief in the instant matter. Mr. L.S. Virk, learned Addl. A.G., Punjab has reiterated that the joining of the petitioner herein would be subject to an affidavit being given in the shape of an undertaking that in case the merit list is re-prepared on final disposal of the writ petition referred to above, the instant writ petition may be allowed in the same terms.

In view of the above, it is directed that the petitioner will appear before respondent No.3 on 24.05.2017 along with an affidavit in the shape of an undertaking that no right would accrue to him by virtue of being permitted to join service by way of these orders, in case, he is not found in the merit list after disposal of Civil Writ Petition No. 12 of 2017. The writ petition is disposed of in the same terms as in CWP No. 4698 of 2017.
