**** MAHABIR SINGH SINDHU , J. (ORAL) Petitioner-Randeep has preferred the instant petition for Habeas-Corpus for releasing of his younger brother, namely, Kuldip @ Dhola (detenue), who is alleged to have been in illegal custody of CIA Staff, Kaithal.
Today, reply by way of affidavit of Tarun Saini, HPS, Deputy Superintendent of Police, Headquarter, Kaithal, has been filed on behalf of respondent No.1 and the same is taken on record. Copy of the same has been supplied to the opposite counsel.
Perusal of para 3 of above affidavit reveals that there are three cases pending against detenue (Kuldeep Singh @ Bhola) and those includes FIR No.102 dated 15.02.2018, under Sections 302, 396, 397, 483, 201 and 120-B IPC read with Section 25 of the Arms Act, registered at Police Station City Kaithal and he is in custody in FIR No.102 since 18.02.2018.
In view of above, no further action is required to be taken in the present petition and accordingly, the same is hereby dismissed. ( MAHABIR SINGH SINDHU) March 23, 2018 JUDGE naresh.k Whether reportable?
