Keeping in view the aforesaid stands taken by learned counsel for the parties, the present writ petition is dismissed as withdrawn with liberty to the petitioner to avail his remedy of appeal against the impugned order dated 30.12.2016 (Annexure P-18), in accordance with law. 4.1 In case any such appeal is filed by the petitioner within a period of three weeks from today then the concerned Appellate Authority shall consider the issue of delay by taking into account the fact that the matter had been pending before this Court.
