The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.138 dated 15.12.2019 at Police Station Kotwali Nabha, District Patiala under Section 61/1 of Punjab Excise Act, 1914.

The allegations, in nutshell, are that 50 boxes of liquor meant for sale in Chandigarh were recovered from the area of Nabha, District Patiala, which were being transported in a Bolero vehicle. The petitioner, however, could not be nabbed at the spot but subsequently it was found that the Bolero vehicle used in the occurrence was registered in the name of the petitioner. Learned State counsel, upon instruction from ASI Charan Singh, has informed that pursuant to interim directions issued by this Court on 5.10.2020, the petitioner has since joined investigation and is not required for any custodial interrogation.

In view of the aforestated position, the petition is accepted and the interim directions issued by this Court vide order dated 5.10.2020 are hereby made absolute subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
