Prayer in the present petition filed under Section 483 BNSS is for grant of regular bail to the petitioner in case FIR No.27 dated 17.03.2023, registered under Sections 420, 120-B, 465, 467, 468, 471 IPC (Sections 318, 61, 336, 338, 336(3), 340(2) BNS) read with Sections 25/27/54/59 of the Arms Act, at Police Station Sadar Patiala.

Learned counsel contends that the petitioner, having 5 years old child, has been in custody for last 2 months and 25 days. Reference is made to the FIR wherein it has been stated that the money taken by the petitioner, as a matter of fact, was handed over to mother (not arrayed as accused) of coaccused Gursewak Singh (husband of the petitioner) who is in custody, as also that amount of Rs.3 lakhs were also deposited in the account of one Mandeep Singh Rai by brother-in-law of the complainant and not in the account of petitioner. The case is based on documentary evidence. There is no direct allegation against the petitioner. Challan has been presented on 18.05.2026, charges have not been framed and in all there are 25 PWs. She is not involved in any other case.

The custody certificate dated 18.05.2026, filed by the learned State counsel is taken on record. As per the same, the petitioner is behind bars for 2 months and 25 days.

CRM-M-27130-2026 (O&M) specific allegations against the petitioner as also her husband and brother-in-law with regard to cheating complainant on pretext of procuring government job. However, she is unable to controvert the submissions with regard to stage and petitioner being not involved in any other case. 5.

Considering the facts and circumstances of the case, in particular that the petitioner is in custody for the last 2 months and 25 days; not involved in any other case; challan stands presented on 18.05.2026, charges are yet to be framed and there are total 25 PWs, the trial is likely to take a considerable time, further incarceration of the petitioner would be violative of her right enshrined under Article 21 of the Constitution of India, the present petition is allowed. 7.

The petitioner is ordered to be released on regular bail on her furnishing requisite bail bond/surety bond to the satisfaction of the trial Court/Duty Magistrate, concerned.

It is made abundantly clear that in case there is any breach of the conditions imposed by the concerned Court, the State shall be at liberty to seek cancellation of bail as granted to the petitioner by this order. 9.
