Reply by way of affidavit of Davinder Kumar, Deputy Superintendent of Police, Patran has been filed in court. Same is taken on record. Learned State counsel has referred to para 4 thereof. Same reads as under:- "That according to the statement dated 28-3-18 (Annexure R-2) of Bindiya Rani wife of the petitioner, she was having family relation with the petitioner. They were well known to each other being students. On 5-3-2018, the petitioner took her to Sanauri Adda Road, Patiala under wrong pretext. After reaching there, his family members pressurized her to perform marriage rituals and also got her signature on some papers typed in English, without getting read the said papers. When she enquired about all these facts, then he did not gave any satisfactory reply. Thereafter, his family members took her to Chandigarh in a vehicle. She has not married to the petitioner Ajay Kumar 2018.04.19 15:43 I attest to the accuracy and authenticity of this document
CRWP No. 305 of 2018 with her consent nor she signed against her parents for protection, which were prepared by them and nor her parents kidnapped her and nor her parents and other relatives have kept her as detenue. Out of her free will, she is residing with her parents at village Gulahar in good condition and nor she do not want to have any marriage relationship with the petitioner. The petitioner and his family members and relatives are threatening her to take away by kidnapping forcibly." In view of above, no cause of action survives in this petition. Dismissed.
