***** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of Mandamus directing the respondents to appoint the petitioners (seasonal worker) for the post of Seasonal Breeding Checker for Malaria session (01.07.2020 to 31.12.2020).

I have heard learned counsel for the parties and gone through the case file.

In the return filed on behalf of respondents No.1 to 4, inter alia, following stand has been taken in para 8 of the preliminary submission and para 2 and 3 of the para wise reply on merits: "8. That the present writ petition has become infructuous as the prayer made in the writ petition has been rendered infructuous as the petitioners had sought quashing of the selection list dated 29.06.2020 whereby the private respondents nos.5 to 11 had been deployed for the post of seasonal breeding checkers for malaria season (01/07/2020 to 31/12/2020) and this period has now ended. It is further submitted that for the upcoming malaria season for the year 2021, the selection of the breeding checkers would be done on the recommendation of Govt. of India for the season for the year 2021 and as per the criteria to be laid down by the State Government pursuant to the recommendation of the Govt. of India."

That the contents of the Para No.2 of the writ petition are a matter of record, in regard to the deployment of the seasonal breeding checkers but it is denied that they are given seniority according to the days they worked in each year as the deployment is purely seasonal and contractual and is not against any regular sanctioned post.

That in the reply to the contents of Para No.3 of the writ petition, the details of the period of work of the petitioners is annexed herewith as Annexure R-3. It is denied that the petitioners worked continuously from the year 2016 till month of December, 2019. It is also denied that the services of the petitioners were not regularized due to non-availability of the vacancy and it is submitted that the petitioners are not entitled for regularization in view of the fact that their engagement was purely seasonal and contractual and not against any vacant sanctioned post. The submission made in the preliminary submissions are reiterated but not repeated for the sake of brevity."

Apropos, neither any additional affidavit and/or replication has been filed and said stand therefore remains uncontroverted. In view thereof, no grounds are made out to interfere. Dismissed.
