*** Rajiv Narain Raina, J. (oral) On 1.10.2015, this Court passed the following order:- "Mr. Khanna contends that the select list was drawn in January 2014. Appointments have followed. Challenge to the selection has been brought in July 2015. However, in para.5 there is an averment that the petitioner made an application under RTI to 2nd respondent who supplied a list of selected candidates as also a list of candidates who applied pursuant to the advertisement, but no information as far as interview marks have been received, though requested.

Learned counsel prays for time to place on record copies of the requests made and the letter received from the PIO so as to help the Court understand the effect of delay of 1 year and 10 months in approaching this Court praying for setting aside of the selection.

List again on 05.11.2015".

CWP-15542-2015 -2Today a request is made to withdraw the petition. The case hangs on an averment made in the petition in para 5 that an application was moved under the RTI Act. If the petitioner is unable to support the query of the Court then the inference is that the averment is incorrect. Copies of the request made and the letter received from the PIO has not been produced to understand the question of delay and laches in approaching Court in matter of public appointments. Consequently, this petition is dismissed.
