**** SHEEL NAGU, CHIEF JUSTICE (Oral) The petitioner has filed the present petition for grant of regular bail in case FIR No. 366 dated 19.04.2023 under Section 346 IPC (Sections 302, 201, 120-B IPC added later on) registered at Police Station Civil Line, Sirsa, District Sirsa.

Status report filed on behalf of the respondent-State of Haryana is taken on record.

The petitioner is in custody since 02.05.2023 for the commission of offence of murder. Though there is no direct evidence but the entire case bhinges upon circumstantial evidence. The trial is in progress and out of 20 enlisted prosecution witnesses, only two witnesses have been examined. The complainant has not yet been examined as a witness. In view of the above and looking to the gravity of the offence, it would be appropriate that examination of the main prosecution witnesses to be completed before the bail application of the petitioner is considered. Therefore, the application of the petitioner for grant of regular bail is dismissed for the time being with liberty to come again after examination of main prosecution witnesses or if the trial gets further delayed, whichever is earlier.
