***** KARAMJIT SINGH , J. (Oral) Prayer is for grant of regular bail in case having FIR No.465 dated 13.8.2019 registered under Sections 379-A, 201 IPC at Police Station City Jind, District Jind.
As per the allegations in the FIR, the complainant placed his bag containing his mobile phone on the ground and thereafter he started drinking water and in the meanwhile some unknown persons has stolen his mobile phone from his bag. The petitioner is in custody since 3.9.2019. As per the State counsel, he is also facing some other criminal cases of similar nature and the recovery of abovesaid stolen mobile was effected from him. ( 2 ) CRM-M-36166-2021 It is a matter of evidence that the present case is of theft or of snatching of mobile. The present petition cannot be declined simply on the ground that the petitioner is involved in number of other cases of theft. It will take time for conclusion of the trial, so no purpose is going to the served by keeping the petitioner behind bars.
Keeping in view facts and circumstances mentioned above and without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the CJM/Duty Magistrate concerned.
