The petitioner brings to challenge an order passed by the Appellate Authority exercising his powers under Section 127 of the Electricity Act. The impugned order is arising out of an appeal to a final order of assessment made under Section 126 of the Electricity Act for alleged unauthorized user. The petitioner contended that he was assessed for consumption of electricity for running a printing press which was assessed as "SP Category". The assessment was sought to be reviewed as unauthorized on the ground that it is Non Residential Service (NRS) Category for consumption less than 10 KWs and as per Sales Manual the assessment had been wrongly made as for SP Category when it should have been NRS Category. His objection that he has been at all times assessed under SP Category and that it should not be changed was rejected by reference to the Sales Circular and the categorization that it involved, namely, that it should have been assessed only as a NRS
CWP No.1559 of 2015 -2category. I have seen also the copy of the Sales Manual which bears out clearly that it would qualify only as NRS category and the assessment made requiring the petitioner to pay ` 14,389/- conforms to law and there is no error for intervention.
2.
The impugned order is sustained and the writ petition is dismissed.
