Dated Police Station Sections 15.06.2023 Punjab State Crime, Phase-IV, SAS Nagar 406, 420, 120B IPC Seeking quashing of above captioned FIR, petitioner has come up before this Court primarily on the grounds that it is a case of double jeopardy and on the same set of allegations, complainant had got registered an another FIR No.104 dated 25.03.2021 at Police Station Kutubsher, District Saharanpur, Uttar Pradesh (Annexure P-4). 2.

Counsel for the petitioner submits that proceedings in the said FIR have been stayed by the Hon'ble High Court at Allahabad. He further submits that on the same set of allegations, present FIR (Annexure P1) has been registered. Petitioner's counsel further submits that in the earlier set of allegations, another complaint was filed in Hoshiarpur wherein petitioner has been exonerated but the said fact was not considered by the investigator in the investigation of present FIR.

Although no notice has been issued, but State has apprised this Court that it was a visa fraud and money had also been received in the account of present petitioner. Be that as it may, there is a specific allegation of the complainant of cheating in the name of providing visa which has to be investigated. Counsel for the petitioner submits that it is a concocted story. It is clarified that if allegations made by the complainant are found to be false and incorrect, the concerned officer is directed to proceed against the informant under Section 181/182 IPC (section 216/217 of BNS 2023) whichever is applicable. The investigation is at primary stage and it is not a case to quash the FIR, which has been sought. As brought to the notice of this Court, petitioner's anticipatory bail is also stands rejected on merits also, the present petition is dismissed with the aforesaid observation.
