*** Daya Chaudhary, J. (Oral) Petitioner-Ayadwinder Singh sent a written complaint addressed to Hon'ble the Chief Justice of this Court, for taking action against illegal detention of his brother-in-law by the Police as he was picked up at 6.00 am from his farm house. It was also mentioned in the application that the petitioner is having apprehension that his brother-in-law has been implicated in a false case at the instance of Local MLA/Cabinet Minister of Dera Baba Nanak.

Said application dated 27.04.2018 was treated on judicial side as Criminal Writ Petition No.402 of 2018 wherein notice of motion was issued on 04.05.2018.

In response to notice of motion, reply has been filed by learned State counsel wherein it has been mentioned that one Jagdish Singh made complaint dated 14.04.2018 in the office of Senior Superintendent of Police, Neetu Rani 2018.08.01 15:15 I attest to the accuracy and authenticity of this document Chandigarh

Criminal Writ Petition No.402 of 2018 Gurdaspur regarding fraud of Panchayat Land, Kalanaur during the year 2014-2015. Said application was marked to Deputy Superintendent of Police, Sub-Division Kalanaur to verify the facts. An inquiry was conducted and it was found to be a case of embezzlement and wrongful loss to the State. FIR No.41 dated 27.04.2018 under Section 409 read with Section 120-B IPC and Section 13(1) of the Prevention of Corruption Act, 1988 has been registered at Police Station Kalanaur against brother-in-law of the petitioner, namely, Harkirat Singh Padda. Brother-in-law of the petitioner was arrested in that case on 27.04.2018 and the case is under investigation. In view of the stand taken in the reply, it cannot be said to be a case of illegal detention and the present petition being devoid of any merit is, hereby, dismissed.
