Claimants filed petition under Section 166 of the Motor Vehicles Act, 1988, seeking compensation on account of death of Parveen Kaur, who died in a motor vehicular accident on 18.08.2006 at the age of 32 years.

As per the claimants, the deceased was a tailor by profession and was also running a dairy, earning Rs.5,000/- per month, apart from being a homemaker. The Tribunal awarded a lumpsum amount of Rs.2,00,000/-.

Counsel for the appellants submits that the Tribunal erred in awarding a lumpsum amount instead of resorting to multiplier method. In the considered opinion of this Court, the enhancement needs to be reworked.

(O&M) Keeping in view that the deceased was an able-bodied young lady aged 32 years, her income is assessed as Rs.6,000/- per month. Future prospects of 40% need to be added. As per ratio of law laid down in ultiplier of 16 needs to be applied. Deduction of 1/4th needs to be applied. The claimants shall also be entitled for funeral expenses of Rs.15,000/-. Rs.15,000/- is awarded on account of loss of estate. Each of the claimants is entitled to Rs.40,000/- on account of loss of consortium. Disposed off accordingly.

Pending miscellaneous application, if any, also stands disposed off.
