ALKA SARIN, J. (ORAL) 1.

This is a petition under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail to the petitioners in FIR No.0028 dated 28.04.2023 under Section 306 of the Indian Penal Code, 1860, registered at Police Station Bhagwantpur, District Rupnagar (Annexure P-1).

On 19.06.2023 the following order was passed:- "Learned counsel for the petitioners submits that petitioner No.1 is the brother-in-law (husband's brother) of the deceased Rano Kaur and petitioner No.2 is the mother-in-law. He submits that the husband Gurvinder Singh is already in custody. He further submits that on 26.04.2023 i.e. a day before Rano Kaur committed suicide, a compromise had been arrived at

-2with Gurvinder Singh (Annexure P-5) and in this compromise, there is no allegation against the present petitioners. He submits that the petitioners are willing to join investigation and abide by any condition imposed by this Court.

Notice of motion.

Mr. Mohit Kapoor, Addl. A.G., Punjab accepts notice on behalf of the respondent-State.

List on 31.08.2023.

In the meantime, the petitioners are directed to join investigation. In the event of arrest, they shall be released on interim bail to the satisfaction of the Arresting/Investigating Officer, subject to compliance of the provisions of Section 438 (2) Cr.P.C."

Learned counsel for the petitioners would contend that pursuant to the said order the petitioners have joined investigation and have fully cooperated.

Learned counsel for the State on instructions from ASI Davinder Kumar has stated that the petitioners have since joined investigation and have fully cooperated and that they are no longer required for further custodial interrogation as of now. 5.

In view of the above, the order dated 19.06.2023 is made absolute. The petitioners shall, however, join investigation as and when called. The petitioners shall also abide by all the terms and conditions as specified under Section 438(2) of the Code of Criminal Procedure, 1973.

Disposed off accordingly. Pending applications, if any, also stand disposed off.
