CHANDIGARH CRWP No. 45 of 2018 Date of decision : 06.03.2018 Sarabjit Kaur ....Petitioner V/s State ....Respondent BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Ms. Swati Batra, Advocate as amicus curiae for the petitioner. Mr. C.L. Pawar, Sr. DAG Punjab.
RAJAN GUPTA J.
Learned State counsel submits that husband of the petitioner was arrested on 15.01.2018 while in possession of Narcotic Drugs. He is in judicial custody at present.
Learned amicus curiae, however, submits that husband of the petitioner was taken away by the police on 14.01.2018. Thus, his false implication cannot be ruled out. This court does not wish to express any opinion at this stage as same would be subject matter of trial. As petitioner is not in illegal detention, petition is dismissed as having been rendered infructuous.
