(Oral) The grievance of the petitioner in this case is against the eviction order passed in the summary proceedings initiated by the Gram Panchayat under Section 7 of the Punjab Village Common Lands (Regulation) Act, 1961, as applicable to the State of Haryana (for short, 'the Act').

It is evident from the order dated 18.08.2011 passed by the Commissioner, Rohtak Division (P-5) that the petitioner's claim is based upon his alleged possession before the year 1950 and on that premise, he claimed ownership qua the subject land.

On a query whether such declaration has ever been sought by him under Section 13-A of the Act, learned counsel for the petitioner submits and rightly so that he may be permitted to withdraw this writ petition with liberty to institute a petition under Section 13-A of the Act.
