(Oral) Prayer is for grant of anticipatory bail in case having FIR No.48 dated 24.5.2022 registered under Sections 323, 324 IPC (Sections 325, 326, 336 IPC added later on) Sections 365, 148, 149 IPC read with Section 25/27 of Arms Act at Police Station Qila Lal Singh District Batala. Counsel for the petitioners inter alia contends that the present petitioners are falsely implicated in this case and only simply injury has been attributed to petitioner No.1 while injury attributed to petitioner No.2 is on GAURAV SOROT 2023.01.19 16:49 I attest to the accuracy and authenticity of this order, judgment and documents.
( 2 ) CRM-M-32356-2022 non-vital part of complainant-Jagdish Singh. The counsel for the petitioners submits that there is cross-version as per which opposite party caused injuries to petitioner No.2 and regarding the same representation is now pending with the concerned District Police Authorities. The counsel further submits that the petitioners have joined investigation with the police in the light of previous order of interim bail passed by the Coordinate Bench of this Court.
State counsel on instructions from ASI Santokh Singh has admitted that petitioners have joined investigation with the police and got effected recoveries of respective weapons used by them at the time of commission of crime and are no more required for further investigation or custodial interrogation by the police.
In view of the above, without commenting on the merits of the case, the present petition is hereby allowed and order dated 27.7.2022 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
