(ORAL) The present petition has been filed by the petitioner under Section 439 Cr.P.C for grant of bail pending trial in case FIR No.84 dated 10.03.2023, registered under Sections 384, 389 read with Section 34 of the Indian Penal Code, 1860, (Sections 18C and 27-A of the NDPS Act were added later on) at Police Station Bhuna, District Fatehabad. It is submitted by the learned counsel for the petitioner that the case against the petitioner is totally concocted. The petitioner is not involved in the crime as alleged against him. Even the main accused-Kavita, from whom the contraband was recovered, has already been released on bail pending trial by the co-ordinate Bench of this Court. The petitioner is not required for any investigation purposes and that he is in custody since 10.03.2023. On the other hand, learned State counsel, being instructed by ASI Dalbeer Singh, has submitted that the petitioner is directly involved in the case, along with the co-accused. However, it is not disputed that the said co-accused, with more serious allegations in the case, has already been granted concession of bail pending trial by this Court. In view the above, but without expressing any further opinion on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on bail pending trial subject to his furnishing bail bonds/surety to the satisfaction of the Trial Court/Duty Magistrate, concerned.
