(Oral) The petitioner has approached this Court seeking issuance of a direction to respondents No.2 to 4 to protect his life and liberty as he apprehends threat to the same at the hands of respondent No.5. Another prayer has been made for issuance of direction to respondents No.2 to 4 to take appropriate action on complaint dated 27.7.2021 (Annexure P-3) and also on representation dated 11.8.2021 (Annexure P-4). Learned counsel for the petitioner submits that he is working as a Sweeper in Municipal Corporation, Ludhiana and on 5.7.2021 he was

- 2 - deputed to serve respondent No.5 with a challan for having contravened the rules of the Municipal Corporation, inasmuch as it was found that he was allowing his pet animals to excrete in public place. However, respondent No.5 instead of accepting the challan used foul language and tore the challan. It is the case of the petitioner that entire incident had been captured in CCTV footage.

Learned counsel submits that subsequently, when the petitioner reported the matter to his higher authorities, Inspector, Health, Municipal Corporation, submitted a formal complaint to the Commissioner of Police, Ludhiana, for taking action against respondent No.5 and ever since respondent No.5 has been threatening the petitioner to withdraw the complaint. It has been submitted that although the petitioner had represented to the Commissioner of Police, Ludhiana, for providing security to him but to no avail.

Having heard the learned counsel for the petitioner and without commenting anything as regards the veracity of the averments made in the petition, the instant petition is disposed of with a direction to respondent No.2- Commissioner of Police, Ludhiana, to look into the matter and to get the application dated 27.7.2021 (Annexure P-3) submitted by Inspector (Health), Municipal Corporation, Zone-D, Ludhiana, Ward No. 83, examined and in case it is found that the same discloses commission of some offence, then appropriate action as warranted under law be taken against the accused. It is further directed that the alleged threat perception of the petitioner as has been disclosed in his representation dated 11.8.2021

- 3 - (Annexure P-4) be also got examined and necessary steps as warranted be taken thereupon in accordance with law.

A copy of this order along with copy of application dated 27.7.2021 (Annexure P-3) and representation dated 11.8.2021 (Annexure P4) be sent to respondent No.2-Commissioner of Police, Ludhiana, for necessary compliance.
