In the High Court of Punjab and Haryana, at Chandigarh Criminal Misc. No. M-27915 of 2019 Date of Decision: 04.07.2019 Harnek Singh ... Petitioner(s)

Versus

State of Punjab ... Respondent(s) CORAM: Hon'ble Mr. Justice Shekher Dhawan.

Present:

Mr. Bikramjit Singh Randhawa, Advocate for the petitioner(s).

Shekher Dhawan, J.

Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 22 dated 29.12.2017, registered under Section(s) 13(1)(d) & 13(2) of the Prevention of Corruption Act, 1988, at Police Station Vigilance Bureau, District Patiala. Learned counsel for the petitioner contended that petitioner has been falsely implicated in the case and subsequently, complainant, namely Pawan Kumar had filed an affidavit (Annexure P2). Having heard learned counsel for the petitioner and perused the documents, this Court is of the considered view that perusal of affidavit (Annexure P2) reveals that it is just a piece of paper, which is undated and no authenticity is attached to such a document. More so, there are specific allegations of corruption against the present petitioner and he has been evading the process of law for more than one and a half years. DEEPAK KUMAR BHARDWAJ 2019.07.04 15:13 I attest to the accuracy and integrity of this document

Criminal Misc. No. M-27915 of 2019 In view of above, no case is made out to grant the concession of pre-arrest bail to the petitioner and as such, present petition stands dismissed.
