******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.100 dated 26.06.2019 registered for the offence punishable under Section 61 of the Punjab Excise Act, 1914, at Police Station Dhanaula, District Barnala.

Heard.

Learned counsel for the petitioner submits that version of prosecution that petitioner on witnessing the police party ran away from his house is improbable as a person cannot run away in the presence of several police officials.

As per allegations in the FIR, 120 bottles of liquor manufactured for sale in the State of Haryana were recovered from house of the petitioner. Even if submission of learned counsel for the petitioner be believed at this stage still the police requires his custodial interrogation to verify as to how 120 bottles of liquor for sale in Haryana were found in his JITENDER KUMAR 2019.07.26 11:37 I attest to the accuracy and integrity of this document Chandigarh

Keeping in view the fact that liquor for sale in other State was found in the house of petitioner, I find no reason to extend the benefit of anticipatory bail to petitioner at this stage. Dismissed.
