The short grievance of the petitioner in this writ petition is that Gram Panchayat - respondent No.4 is colluding with unauthorised occupants, some of whom have been impleaded as party respondents and allegedly is not initiating any eviction proceeding.

It may be mentioned here that notice of motion was issued only to the Gram Panchayat to show cause as to why action is not being taken against unauthorised occupants. 3.

Learned counsel for the Gram Panchayat though has controverted the petitioner's allegation of collusion, however, he undertakes that the Gram Panchayat shall take action against the unauthorised occupants in accordance with law within two months from the date of receipt of a certified copy of this order.

As an abundant precaution, we direct Deputy Commissioner, SBS Nagar (Nawanshahar) and Additional Deputy Commissioner (Development), SBS Nagar (Nawanshahar) to ensure that lawful action is initiated by Gram Panchayat for removal of encroachments from the Gram Panchayat land.
