IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH * * * CWP-16049-2020 Date of Decision : 1.10.2020 Gurnam Singh Virk and others Petitioners

Versus

Punjabi University, Patiala and another Respondents CORAM: HON'BLE MR. JUSTICE AVNEESH JHINGAN

Present:

Mr. Hardeep Singh, Advocate for the petitioners. Mr. Ajaivir Singh, Advocate and Ms. Shazia Singh, Advocate for the respondents.

* * * AVNEESH JHINGAN, J. (Oral) The matter is taken up for hearing through video conference due to COVID-19 situation.

The present petition is filed seeking directions to Punjabi University, Patiala to release the arrears of DA of the petitioners who are serving employees. Reliance is placed upon various orders of this Court whereby writ petitions were disposed of with the direction to the respondents to decide the legal notices. A similar prayer is made in the present writ petition. However, during the course of arguments learned counsel for the petitioners submits that only DA to those employees are being released who get orders from this Court for decision of the representation. Learned counsel appearing on behalf of the University submits that if similar directions are issued, the legal notice of the petitioners would be decided.

CWP-16049-2020 From the stand of the University, it is apparent that un-called for litigation is being invited.

Before any further observations are made, learned counsel for the University seeks a pass over to have instructions as to whether University is deciding the issue with regard to DA pending of all the employees or not. The matter is passed over.

After pass-over Mr. Ajaivir Singh, Advocate, on instructions, submits that it is incorrect that the respondent/ University is only considering the case of the employees who are approaching the High Court rather the endeavour is to release the arrears of DA of all the employees who are entitled to it. He submits that legal notice dated 19th June, 2020 of the petitioners would be decided expeditiously and not later than two months from today. He also ensures that the University would make its best efforts that no further employee has to approach this Court for release of arrears.

Let the needful with regard to other eligible employees be done within three months from today and monetary benefits be released thereafter, if found entitled to.

It is expected from the University that in case any representation is received from the employees for the arrears of DA, they would be immediately informed about the Court's order and that their matter is being considered in a time bound manner.

The petition is disposed of.
