Present:

Ms.Akshita Chauhan, Deputy Advocate General, Punjab. Mr.Ashok Kumar Bazaz, Advocate for respondent Nos.3 and 4.

........

RAJESH BHARDWAJ, J.(ORAL) Petitioners have approached this Court praying for setting aside/recalling of sewerage disposal bill, issued for a period of 01.04.2020 to 31.03.2021, to petitioners No.2 to 6 by respondent No.3 towards discharge of waste water into the Municipal Sewerage. It is further prayed to restrain respondent No.3 from recovering the exorbitant amount and from taking any coercive action/steps against the petitioners in pursuance of aforementioned sewerage disposal bills, issued to the petitioners during pendency of the present petition. It is further prayed to issue direction to the respondents to issue sewerage disposal bills after taking the meter reading as to the actual disposal of wate by the petitioner industries into the municipal sewerage and after following the provisions of Municipal Corporation Act, 1976. MEENU 2023.11.08 17:32 I attest to the accuracy and integrity of this order/judgment

CWP-15989-2020 -2It has been contended by learned counsel for respondents No.3 and 4 that petitioners have already deposited the amount of bill issued to them. He has submitted that they have issued sewage disposal bills to the petitioners on the basis of Notification dated 02.09.1994, the validity of which has already been upheld by the Hon'ble Division Bench of this Court in Ludhiana District Cooperative Milk Producers Union vs State of Punjab and another 2013(19) RCR (Civil) 398 and thus, the petitioners, at this stage, cannot dispute the vires of the same. However, he submits that respondents/department has already formed Dispute Settlement Committee and in case the petitioners have any grievance, they can approach the Committee and the same would be redressed in accordance with law. Thus the petition is disposed of with liberty to the petitioners to approach the Dispute Settlement Committee for the redressal of their grievances, if any.
