This petition has been filed under Section 528 of BNSS (Section 482 Cr.P.C) for quashing/setting aside of proclamation order dated 01.04.2026 passed by ld. SDJM, Dasuya District Hoshiarpur in FIR No. 21 dated 13.06.2025 under Section 304 BNS (previously Section 379-B IPC) registered at GRP Jalandhar with a further prayer for the stay of further proceedings on the basis of order dated 01.04.2026 passed by ld. SDJM Dasuya. 2.

Learned counsel for the petitioner submits that the petitioner could not appear before the learned trial Court as the petitioner had never been duly served with the summons allegedly issued by the ld. Court. He further prays that the petitioner is ready and willing to join the proceedings before the Court and the impugned order dated 01.04.2026 be set aside. 3.

I have heard learned counsel for the parties and gone through the case file.

In view of the limited prayer made by the learned counsel for the petitioner, this Court does not find any legitimate ground to interfere in the impugned order 01.04.2026 passed by ld. SDJM, Dasuya District Hoshiarpur. However, in case the petitioner surrenders before the trial Court within a period of 07 days from today at 10:00 A.M and moves an application for grant of regular bail, the trial Court is directed to consider and decide the same within a period of three days.
