(ORAL) In the present writ petition, petitioner had sought the financial benefits for the period from 04.09.1985 to 31.12.2009, but at the time of hearing, counsel for the petitioner states that the said prayer is not being pressed.
Counsel for the petitioner argues that petitioner was entitled for promotion to the rank of Deputy Superintendent of Police from the date his junior Sh. Tarsem Singh was promoted as the said Sh. Tarsem Singh was promoted during the period when the petitioner was out of service.
In the reply to the said claim, the respondents-State has stated that case of the petitioner for the grant of promotion with effect from the date of his junior was promoted, has already been sent to the competent authority, vide letter dated 30.01.2018 (Annexure R-1) and the same is NARESH KUMAR 2019.05.13 15:15 I attest to the accuracy and integrity of this document Chandigarh

Counsel for the petitioner states that at this stage, petitioner will be satisfied in case a time bound direction is issued to the respondents to take the appropriate decision on the recommendation/letter dated 30.01.2018 (Annexure R-1) by the competent authority by passing a speaking order.
Counsel for the respondents states that he has no objection in case the direction is issued to the competent authority to decide the claim for the grant of promotion to the petitioner with effect from the date of his junior by passing the appropriate orders in a time bound manner. In view of the above, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to take the appropriate decision on the recommendation/letter dated 30.01.2018 (Annexure R-1) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order, if already not taken. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.
Present writ petition stands disposed of.
